Agency/Client Contract FAQs
Key Information
The specifics may vary depending on the agency, but we will typically receive the assignment details through an Assignment Contract or via an email from the agency. This information will include your contract rate and the start/end dates of your assignment. Once we receive this information, we will create an assignment for you on our Portal and email you the Assignment Details for your records. We will also need your acceptance of the assignment, allowing us to sign the contract with the agency. Initially, there will be one assignment contract per role, and there may be extensions or amendments as needed.
Where can I find my Assignment Contract?
If we have received an Assignment Contract from your agency for your role, you can usually find it by clicking on the hyperlink at the bottom of the Assignment Details email we sent you. If you’re unsure, please reply to that email, and a member of our Contracts Team can confirm it for you.
Where can I find out if I need to submit any timesheets to SmartWork for payment for this assignment?
Information about whether you need to submit timesheets or any other information on SmartWork’s portal can be found in the body of the Assignment Details email. You can also find a step-by-step guide in our Knowledge Hub by searching for ‘timesheets’. Typically, you must submit timesheets per your payment frequency, such as weekly submissions for weekly payments. The specific requirements will be confirmed in the same email.
I have received the Agency Contract/Assignment Details, and the information is incorrect, what do I do?
If you believe the Agency Contract or Assignment Details information is incorrect, please reply to the Assignment Details email and provide us with the correct information. Our Contracts Team will then communicate with your agency to confirm or request the updated information.
What is the restrictive clause?
Restriction clauses are commonly included in agency contracts, and SmartWork will adhere to this practice when applicable. Our restrictive covenant is a standard clause that can be found in various contracts between umbrellas and agencies.
It states that during your employment and for a certain period after it ends, you are prohibited from approaching the end client you have been working for or any customers you have conducted business with in an attempt to secure new employment.
This clause is in place to prevent you from bypassing the agency’s involvement in the agreement. However, if your agency has an existing agreement with your end client or has given consent for you to seek employment directly, then you are not bound by this clause. Nevertheless, it is important to discuss this matter with your agency if you are considering taking such action. If a similar clause is absent in the assignment contract or master agreement provided by your agency, the restrictive covenant will not apply to your assignment.
